Who Owns the ‘Airspace’ above your property?

Most people assume that buying a home means they own everything above it – but that is not always the case.

In some circumstances, the rights to the airspace above a property can be sold, reserved or excluded from the title. This means that the space above your property may not always form part of what you own.

This could be important if:

  • You are planning a loft conversion or wish to add another storey.

  • A previous owner has retained or sold the airspace rights.

  • You are buying a flat where the roof space or airspace is not included within the lease.
